Brooke Boltz, Esq.
Brooke Boltz is an experienced Personal Injury Protection (PIP) litigation attorney. Although she owns her own law firm, Boltz Legal, Brooke is excited to serve Kemp, Ruge & Green Law Group in an “of counsel” capacity. Prior to opening her own firm, Brooke Boltz was a Partner at a large insurance defense firm where she supervised a team of 12 PIP lawyers. Brooke has represented clients in complex and high profile PIP and SIU cases including federal affirmative actions. Although PIP trials are fairly rare because most cases resolve by summary judgment, Brooke tried PIP cases in 2015 and 2016 and prevailed on her client’s behalf. She has obtained several PIP trial court and appellate opinions in her favor.
Brooke has successfully litigated PIP suits involving reasonableness of charges, medical necessity of treatment, diagnosis of emergency medical condition, exhaustion of benefits, 6(b) issues, timeliness of treatment, withdrawal of benefits due to independent medical examinations, and many others. While Brooke’s practice currently focuses primarily on PIP and SIU, she also has experience in the areas of general civil litigation including: professional malpractice, premises liability, wrongful death, products liability, vehicle negligence (ie. automobiles, commercial tractor-trailers, motorcycles, forklifts, recreational off-road vehicles, and personal watercraft), negligent security, dram shop, and foster care lead agency and community based care defense. As an example of her varied experience, Brooke’s first trial involved defending a very experienced lawyer in a legal malpractice action where she obtained a complete defense verdict for her client.
Following her undergraduate studies at Stetson University, Brooke worked as a probation and Pretrial Services officer for three years. Her experience in the courtroom as a probation and court services officer motivated her to pursue a career as a lawyer. Brooke then obtained her Juris Doctorate, with honors, from Stetson College of Law where she met and became friends with Stacy Kemp.
