Who is protected under discrimination laws?
Federal law prohibits discrimination based on race, color, national origin, age, sex, religion, disability, citizenship status, genetic information, medical conditions and pregnancy.
Florida law adds protections for marital status, AIDS/HIV and the sickle cell trait. In some cities and counties in Florida, sexual orientation and gender identity are considered protected groups.
Which government agencies handle discrimination?
The involvement of government agencies depends on what type of discrimination you faced and where it occurred. For workplace violations, the Equal Employment Opportunity Commission (EEOC) may be involved. Florida’s Commission on Human Relations enforces state discrimination laws. These groups may or may not need to be directly involved with your case.
Does my employer have to follow anti-discrimination laws?
Under both federal law and Florida law, anti-discrimination laws cover employers with 15 employees or more with some exceptions. Age discrimination applies to those with 20 employees or more.
