Types of Car Accident Claims We Work On

No two car accidents are alike. You need an attorney on your side who will take a unique, personalized approach to investigating your crash and building your accident claim while also having experience in a wide range of car accident case types. At the law office of Kemp, Ruge & Green Law Group, our Holiday, FL car accident lawyers can help you if you’ve been in a:

  • Rear-end crash. Rear-end crashes are typically regarded as the least serious but most common type of car accident. At the Kemp, Ruge & Green Law Group, we’ve seen some rear-end crashes that are in fact very serious. Let us help you recover the compensation you deserve.
  • Head-on collision. A head-on collision is one of the most serious crash types – these types of accidents are often fatal. If you’ve been in a head-on collision and have suffered serious injuries, our legal team will be by your side to help you prove fault and get a settlement.
  • Side-swipe accident. Often a result of illegal lane changes, driving in a blind spot, and failure to look, side-swipe accidents can be serious, especially when they occur at high speeds.
  • T-bone crash. A T-bone accident occurs when the front-end of one vehicle strikes the side of another, forming a T-like shape. These accidents usually occur at intersections.
  • Rollover accident. Rollover accidents can occur because a vehicle trips, because it tips when taking a turn too fast, or because it collides with another object that forces a rollover. Rollover accidents can be very serious, especially if vehicle occupants are ejected during the crash.
  • Multi-vehicle pileup. While most multi-vehicle pile-ups happen at low speeds and, fortunately, don’t lead to serious injuries, when they do, getting to the bottom of who caused the case is important. Unfortunately, determining fault in this type of accident can be complex, not least of all because of the number of motor vehicles involved.

Car Accidents in Holiday Lead to Tragic Injuries

When a car accident occurs, it could lead to tragic injuries. Factors that can impact the severity of the accident and the amount of force involved in a crash include the angle and type of collision, the speed at which vehicles are traveling at the time of impact, and the safety features of the vehicles and their use, including whether or not occupants are belted at the time of crash.

Types of injuries and losses a person may suffer following a serious crash include:

  • Traumatic brain injuries. If a person suffers a bump or blow to the head, or the penetration of the skull, they may suffer a traumatic brain injury (TBI).
  • Spinal cord injury. One of the most tragic types of injuries that a person can incur is a spinal cord injury. This type of injury is irreversible, and can lead to partial or complete paralysis.
  • Injuries to extremities. A person’s extremities may be severely harmed in a crash. Bone fracture injuries, crush injuries, amputation injuries, soft tissue injuries, and lacerations and skin injuries are all common.
  • Internal injuries. In a car accident, a person’s internal organs may be damaged if they sustain blunt force or trauma, or if they are punctured by an object or a broken bone. For example, a broken rib may puncture a lung.

In addition to serious injuries, a car accident victim will likely incur expensive medical bills, suffer a disability that leaves them unable to work, and perhaps develop psychological injuries, too. Pain, suffering, and emotional distress are also common.

Being in a car accident may be the most traumatic event of your life. If you’ve been in a crash caused by someone else’s negligence, you need a skilled attorney on your side who will advocate for your rights. At the Kemp, Ruge & Green Law Group, our lawyers understand what you’re going through.

Land O’ Lakes Motorcycle Accident

VIDEO TRANSCRIPT

Experienced Personal Injury Lawyers Serving Land O’Lakes, Florida

“Best firm out there! They walked us through step by step and took care of everything for my husband. I would recommend this firm to anyone.”

-Emma S.

Riding a motorcycle in Florida can be a truly incredible experience. With the wind in your hair and the sun at your back making for a perfect temperature, and the views–from coastlines to lakes–topping off the sensation of wonder, we understand why we have a lot of motorcyclists in our state. But as great as riding a motorcycle may be, motorcycling is an activity that’s much more dangerous than just driving a car. In fact, motorcyclists are disproportionately at risk of being severely harmed or killed when a crash occurs, as compared to drivers of motor vehicles.

If you or a loved one has been harmed in a crash, our Land O’Lakes, FL motorcycle accident attorneys at the Kemp, Ruge & Green Law Group can help. Please reach out to our law firm today for a free consultation and more information about your rights after a serious motorcycle accident.

What to Know About Our Land O’Lakes, FL Motorcycle Accident Lawyers

If you’ve been severely harmed in a motorcycle crash–or if, tragically, you’ve lost a family member in a motorcycle accident–there should be no doubt in your mind about hiring a lawyer. Rather, you should be focused on how to find a great lawyer and what to expect from your legal advocate. When you choose the Land O’Lakes motorcycle accident lawyers at the Kemp, Ruge & Green Law Group, things you should know about us include:

  • We’re experienced. You don’t want an inexperienced law firm handling your motorcycle accident case – there’s too much on the line. Instead, you want an advocate who has been around the block a time or two and who knows the insurance companies, police officers, and judges that may be involved in your case. You want someone who understands best practices for proving their clients’ claims and recovering large settlement awards.
  • We have the resources your case demands. Whether you’re just trying to settle a claim out of court or have brought forth a personal injury lawsuit, your case will demand resources in terms of time, money, and human capital. We have the resource that your case requires, including the means to hire necessary experts and the staff to support our lawyers every step of the way during your case.
  • We put our clients first. In a motorcycle accident claim, the most important person involved in the case is you. When you hire our law firm, you can count on a personalized case strategy, detailed attention, and the accessibility and availability of our attorneys, even after hours. We won’t cut corners when it comes to representing you.

Injuries and Damages in a Motorcycle Crash

The range of potential injuries sustained in a motorcycle crash is huge. Common injuries that motorcyclists may sustain include:

  • Head and traumatic brain injuries;
  • Back and neck injuries;
  • Soft tissue injuries;
  • Bone fractures;
  • Injuries to extremities;
  • Crush and amputation injuries;
  • Spinal cord injuries;
  • Internal injuries;
  • Psychological injuries; and

Of course, these injuries don’t just mean physical losses – they also mean economic and noneconomic losses in the form of lost wages, medical expenses, property damage costs, and pain, suffering, and emotional distress.

Who Pays for Damages After a Motorcycle Accident?

Unlike the drivers of standard motor vehicles who are required to file a claim with their personal injury protection insurance provider before turning to the tort system, motorcyclists maintain the right to pursue damages against the liability insurance provider of the at-fault driver or file a lawsuit against the at-fault party.

Liability–and who will pay for damages–is based on fault. A motorcyclist will need to prove that the driver involved in their crash (against whom they are filing a claim) did something negligent that caused the accident. Examples of negligence include speeding, driving too fast for conditions, drinking while driving, and performing an illegal maneuver.

Steps to Take Right Now

If you are in a motorcycle crash, important steps to take afterward include:

  • Filing a police report with the police;
  • Seeking medical care;
  • Calling your insurance provider;
  • Gathering as much evidence as possible;
  • Calling a Land O’Lakes personal injury attorney.

You only have so much time to act after a crash! If you wait too long to file your claim or take legal action, your right to recovery may be barred.

Land O’ Lakes Truck Accident

VIDEO TRANSCRIPT

Experienced Personal Injury Lawyers Serving Land O’Lakes, Florida

“Everyone in this group from the front desk staff, assistants, and attorneys are nothing but professional, pleasant, courteous, and very knowledgeable in what they do. I had a wonderful experience and highly recommend them.”

-Krista M.

Even if you are a safe driver around large trucks, it’s impossible to know when an accident is going to happen. From drowsy truck drivers to cargo shifts to road defects and more, truck accidents happen and, when they do, the damages are often devastating for those involved.

At the law office of the Kemp, Ruge & Green Law Group, our experienced Land O’Lakes, Florida truck accident lawyers are here to guide you through the process of filing a truck accident claim and aggressively advocate for your rights along the way. Please reach our Land O’Lakes truck accidents lawyers today for your free consultation.

What to Expect from Our Land O’Lakes Truck Accident Law Firm

If you’ve been in a truck accident, you shouldn’t think twice about hiring a lawyer – you need someone on your side who will be available to support you and make sure that an insurance company doesn’t get away with paying you less than you deserve. When you hire our Land O’Lakes truck accident law firm, you can expect us to:

  • Fully investigate your crash. One of the first things that we’ll do when you hire us is to open an investigation into your crash to determine how the crash happened, who’s to blame for what happened, and against whom a claim should be filed. This process involves being at the scene of the accident ourselves, collaborating with experts, sending spoliation of evidence letters, reviewing the police report, talking to witnesses, and more.
  • Handle your claim. Filing an insurance claim, proving fault and damages, and reviewing a settlement can all be very complicated. You can count on our legal team to do everything that’s necessary along the way, including compiling your paperwork, talking to the insurance company, calculating your damages, and reviewing and negotiating your settlement amount. We know what’s on the line, and you can trust us to do a thorough and accurate job of managing your case
  • Keep you in the loop. Throughout the entire process, we will remain proactive, transparent, and engaged in your case. If you have questions, you can count on us to be accessible and available throughout. We want you to feel as though you have a friend in us.

Why You Need a Lawyer After a Truck Accident

Don’t make the mistake of not hiring an attorney if you’ve been in a truck accident. You need a lawyer because:

  • Your injuries are serious. If your injuries are serious, you are looking at high medical bills and long-term damages, potentially in the form of permanent disability, disfigurement, or/and scarring. You need someone who knows what’s on the line and will work hard to make sure you’re compensated.
  • Your economic and noneconomic damages are severe. If you’ve been injured, disability and high medical expenses aren’t the only damages you’ll incur; you may also be unable to work and sustain lost wages. What’s more, you may also be facing property damage expenses and a wide array of noneconomic damages, like pain, suffering, and emotional distress.
  • Liability is unclear. Liability in a truck accident can be complex. The first step is determining what happened. Potentially liable parties include a trucking company, truck driver, shipper or loader of cargo, the manufacturer of a vehicle or a vehicle party, or another third-party. Note that even when fault lies on the shoulders of one party, however, that may not be who’s liable (i.e. a trucking company may be liable for a truck driver’s actions).
  • You’re not being offered a fair settlement. Insurance companies notoriously low-ball claims and offer people less than they deserve with the aim of saving money in mind. If your claim has been low-balled and you haven’t been offered a fair settlement, we can help.

The Statute of Limitations in Truck Accident Claims

One of the most important things that you need to know is that you only have a limited amount of time to act. After a truck accident, you have four years from the date of the accident to file a lawsuit against the at-fault party. If you breach the statute of limitations, your claim will be barred.

While you may drive countless times throughout your life, it only takes one time for an accident to occur that changes your future. At the law offices of the Kemp, Ruge & Green Law Group, we know how severe and shocking a serious car accident is. If you’ve been in a Land O’Lakes, Florida car accident, you need a lawyer on your side who will advocate for you. When you call our law firm, we will start working on your case immediately and can provide the support and guidance you need.

When Your Life Changes, You Need an Advocate

  • Investigating your car accident case;
  • Hiring accident reconstruction experts and other professionals to build your claim;
  • Talking to the other driver and any witnesses to the accident;
  • Talking to your insurance company and the insurance company of the other driver;
  • Gathering and organizing all evidence pertinent to your case;
  • Working with experts to calculate the degree of damages you’ve suffered;
  • Negotiating your settlement amount; and
  • Filing a lawsuit on your behalf is appropriate.

Throughout the process, we’ll be available and accessible to answer all of your questions, help you to make sense of the process, and provide you with the support and guidance you need. We also represent those who have lost a loved one in a car accident.

No-Fault Car Insurance in Florida

Florida maintains a unique system of car insurance and compensation after a crash called a no-fault system. Under a no-fault system, drivers are required to carry personal injury protection (PIP) coverage and, when a crash occurs, they must file a claim under their PIP coverage with their own insurance company first. In fact, they are barred from filing a claim against the other driver unless their injuries exceed the serious injury threshold. This is true regardless of fault.

For drivers who aren’t in serious accidents, this can be advantageous – for example, even if you’re at fault for an accident or the at-fault driver doesn’t have insurance, you can still file a claim for damages against your own insurance and recover compensation. Of course, limits on PIP coverage are low, and for serious injury cases, stepping outside of the no-fault system is often necessary.

Florida Personal Injury Threshold

If your injuries meet or exceed the serious injury threshold in Florida, you maintain the right to step outside of the no-fault system and file a claim against the at-fault party’s liability insurance, or even file a lawsuit against the responsible driver. According to Florida Statutes Section 627.737, a person can step outside of the no-fault system and seek compensation for noneconomic harm when their injuries include:

  • Significant or permanent loss of a bodily function;
  • Permanent injury other than scarring or disfigurement;
  • Significant and permanent scarring or disfigurement; or

In filing a lawsuit, a plaintiff will need to prove that the defendant owed them a duty of care, that the duty of care was breached, and that the breach was the proximate cause of harm in addition to proving that damages were suffered.

Types of Damages Recoverable in a Car Accident Claim

Our lawyers will advocate for your right to your full compensation amount, including the full value of your economic and noneconomic damages. Types of damages recoverable in a car accident claim include:

  • Medical expenses, past and future;
  • Lost wages, past and future;
  • Loss of earning ability;
  • Property damage costs; and
  • The value of pain, suffering, anguish, and emotional distress.

If you’ve suffered any other losses not listed, you can count on us to work hard to get you every penny you deserve.

Before you even understand what is happening, your life may be forever changed as the result of a negligent driver who causes a serious car accident. When you are healing and focusing on your recovery, call our team for someone who can focus on the claims and settlement process.

We’ll then file a claim against the at-fault party’s liability insurance provider, which should pay for your damages. In some cases, compensation may also be available through your own insurance policy, too, depending on the coverage types you carry. Our team will assist you in exploring the various sources of compensation available to you.

Experienced Personal Injury Lawyers Serving Hudson, Florida

“Brandon, Stacy, Stephanie & Nicole – thank you for your kind and loving support through this challenging time. You all have been so wonderful! Much love!”

-Kara

One of the most terrifying types of motor vehicle accidents is a truck accident. Trucks can weigh upwards of 80,000 pounds–that’s nearly 20 times more than the average passenger car. When a car and a large truck collide, the smaller vehicle is often completely totaled, and any occupants of that vehicle may be severely injured, if not fatally injured. At the office of the Kemp, Ruge & Green Law Group, we understand how devastating truck accidents are, as well as how the aftermath of a truck accident can be painful, confusing, frustrating, and can seem to drag on for an excruciatingly long amount of time. While our team cannot undo what has happened to you, we can offer legal support and representation as you navigate the claims process. If you’ve been in a crash, please reach out to our law firm directly today for a free consultation.

Hudson Truck Accidents

If you’ve been in a truck accident and are dealing with severe injuries, we know that you have a lot of questions. We hope that we can provide you with the information and support that you need during this difficult time.

Liability for a Hudson truck accident

One of the most important things to do in the aftermath of a truck accident is to determine who should be held liable–or legally responsible–for the crash and your damages. Liability in a truck accident can be very complicated, as various theories of liability may exist and many parties may be partially at fault. Potentially liable parties in a truck accident claim include:

  • The truck driver;
  • The trucking company;
  • A third-party passenger car driver;
  • The shipper or loader of cargo;
  • The vehicle manufacturer;
  • The party responsible for road or vehicle maintenance.

How our lawyers can serve you

Working with a skilled truck accident attorney could have a very positive effect on the outcome of your claim. When you choose our law firm, you can count on us to investigate your claim thoroughly, hire any necessary experts, determine and prove liability, calculate the value of your claim based on your damages, preserve evidence, file a demand letter, review and negotiate your settlement, and file a lawsuit and litigate your case if necessary. We will provide you with all of the information you need related to navigating the claims process, will remain available and accessible to answer your questions as needed, and will serve as an advocate for you.

Statute of limitations for a truck accident claim

If you are involved in a truck accident and are filing a truck accident lawsuit, you will have a limited amount of time to do so. We recommend initiating the claims process as soon as possible for a number of reasons, including to preserve evidence and to improve your chances of recovering compensation as soon as possible. In addition to these reasons, though, know that if you wait more than four years from the date of the accident to file a lawsuit for damages, your claim will be barred based on a breach of the statute of limitations, per Florida Statutes Section 95.11.

Common Questions About Truck Accidents in Hudson

  • What is my claim worth?
  • One of the first questions that most of our clients ask us is, “What is my claim worth?” Unfortunately, we will not be able to tell you the value of your claim until after we have thoroughly reviewed all of the evidence in your case, including things like doctors bills and medical reports, wage and income statements, psychiatrists’/mental health professionals’ opinions, financial professionals’ opinions, and more. That being said, we are committed to fighting to get you your full settlement amount, which means compensation for the full value of your economic and noneconomic losses.
  • How long will my case take?
  • Like knowing the value of your claim, we also won’t be able to tell you how long your case will take to settle, as this will depend on a number of different factors, including how complex your case is, the degree of your damages, and the degree of cooperation on the part of the insurance companies involved. We aim to settle your case as quickly as possible without accepting a settlement that doesn’t fairly compensate you.
  • Can I file a claim on the behalf of a loved one killed in a truck accident in Hudson?
  • Losing a loved one in a truck accident is devastating. If you are the surviving family member of someone who has been killed in a Hudson truck accident, our law firm can represent you as you pursue damages through a wrongful death suit.

VIDEO TRANSCRIPT

“Excellent! I was in a car accident and attorney Kemp help me beyond my expectations. Her staff and her were always on top of my case and guided me through the whole process. Very honest and hard working Law Firm. I felt not only that they were helping me but like they were family!”

-Ana

Of all of the types of accidents that can happen, car accidents are one of the most common. Indeed, car accidents are a leading cause of injury and death in our country, and Hudson is no exception. If you have been in a Hudson car accident, our attorneys realize that you may have numerous questions about your rights, what happens next, who will pay for damages, how long your claim will take to settle, and more. Our team at the office of the Kemp, Ruge & Green Law Group can provide you with the legal counsel and support you need as you go through this difficult time.

Hudson Car Accidents

A car accident in Hudson can happen in the blink of an eye. If it does, our legal team wants you to know that we will be by your side to provide support and guidance as you navigate the claims process. Our lawyers will assist you by providing you with a free case consultation and, if you decide to hire us, we will investigate your case, prove fault, build your claim, calculate your damages, file a demand letter, and negotiate your settlement.

Top causes of car accidents

Car accidents are almost always the cause of the negligence of one of the drivers involved. Over the years, we’ve seen car accidents caused by things such as drunk driving, distracted driving, speeding, aggressive driving, and failing to follow traffic laws and basic safety common sense. In addition to negligence, car accidents may also be caused by things like road defects and dangerous conditions, signage errors, and vehicle defects.

Liability for a Hudson car accident

When a car accident occurs in Hudson, liability will be based on fault. Before you bring forth a claim against another driver, though, you’ll need to file a claim against your own policy’s personal injury protection coverage. This is because Florida is a no-fault car accident state, which means that regardless of fault, damages will be pursued against one’s own insurance. You can step outside of the no-fault system, however, if you suffer serious injuries. If this is the case, you can bring forth a claim directly against the at-fault driver’s liability insurance coverage.

Damages recoverable in a Hudson car accident claim

Our lawyers want to make sure that you are compensated in full for the damages that you suffer. Damages that are recoverable include compensation for:

  • Medical expenses
  • Property damage costs;
  • Lost wages; and
  • Pain and suffering.

Common Questions About Car Accidents in Hudson

  • What if the other driver doesn’t have insurance?
  • Fortunately, because Florida is a no-fault state, your first source of recovery will be your own insurance provider, which means that you should be able to recover compensation even if the other driver doesn’t have coverage. In addition to personal injury protection coverage, you may also carry other coverage types, such as uninsured/underinsured coverage.
  • What happens if I am offered less than I think I deserve or my claim is denied?
  • You do not have to accept a settlement offer and, most of the time, rejecting a first settlement offer is the smart thing to do, as claims are often lowballed. If you are offered less than you think that you deserve, you can negotiate for a larger settlement amount. If your claim is denied, you can appeal the denial–our law firm can help.
  • Can I file a lawsuit?
  • You maintain the right to file a lawsuit after a car accident in Florida if your injuries meet the state’s serious injury threshold. However, while you may have the right to file a lawsuit, doing so is rarely advised unless a settlement cannot be reached. Lawsuits can be expensive and their outcomes unknown.

“Extraordinary service! This was my first time using a law firm, I had no idea what to expect. The first meeting set me at ease and I was kept informed on all aspects of the case as it progressed. What a great team to have on your side when you need legal advice and someone to fight for you. Thank you all at Kemp, Ruge and Green for the care and interest you’ve shown me.”

If you live in Dade City, then you know that there are few better places in our state to ride a motorcycle. Indeed, with quick access to the beach and flanked by both a state park and a wilderness preserve, riding a motorcycle in Dade City makes sense for a lot of reasons. But even if you’re the safest motorcyclist on the road, you can’t count on other drivers to be as responsible as you are.

Motorcycle accidents can be deadly, and occur far too often in our state. If you’ve been in a crash, our Dade City motorcycle accident lawyers at the office of the Kemp, Ruge & Green Law Group can help.

Motorcycle Accidents in Dade City

When a motorcycle and a car collide, it is almost always the rider of the motorcycle who is most severely injured. Motorcyclists have few protections–no seat belts, no airbags, and no vehicle frame to protect them. Common injuries that a motorcyclist may suffer as a result of a crash include:

  • Head, neck, and brain injuries;
  • Facial and scalp injuries;
  • Internal injuries, including punctured organs;
  • Burn injuries and road burn injuries;
  • Bone fractures;
  • Spinal cord injuries; and
  • Soft tissue injuries.

For a motorcyclist, brain injuries are often the biggest threat.

Causes of motorcycle crashes

Motorcycle accidents are almost always caused by the negligence of one of the parties involved. When you hire our motorcycle accident lawyers in Dade City, we will investigate your case and make a determination about fault and causation. Some of the most common causes of motorcycle crashes include driver distraction or intoxication, failing to look before changing lanes, failing to double-check blind spots, speeding or driving at an unsafe speed for conditions, driving aggressively, and failing to follow posted traffic laws. In addition to drivers’ dangerous behaviors, car or motorcycle defects may also cause a crash–for example, defective brakes or steering devices could lead to a collision. Finally, road defects, such as potholes, missing or incorrect signage, and debris in the road can also lead to accidents.

Why you need a motorcycle accident lawyer

If you are involved in a motorcycle crash, you are likely facing tens or hundreds of thousands of dollars in damages, including medical expenses, property damage costs, lost wages, and pain, suffering, and emotional distress. The psychological, physical, and financial burden that is placed on you after a motorcycle accident can feel very oppressive. When you hire our law firm, we will work hard to build your case. This means gathering evidence to prove the fault of the responsible party and collecting documentation to prove the extent of injuries you’ve suffered. We’ll also work hard to negotiate your settlement and get you the damages award you deserve.

Common Questions About Motorcycle Accidents

  • How can I afford a Dade City motorcycle accident attorney?
  • Our law firm works based on a contingent fee, which means that your consultation with us is free and we won’t charge upfront or hourly fees. Instead, if we are successful in recovering a settlement on your behalf, we will collect a percentage of your winnings as our fee. If we don’t recover a settlement, you won’t owe us a cent.
  • How much time do I have to bring forth a claim?
  • We recommend initiating the claims process as soon as possible With that in mind, though, you have four years from the date of your accident to file a lawsuit for damages, per Florida Statutes Section 95.11. If you wait longer than this, you’ll be permanently barred from recovery.
  • Can I still recover if I wasn’t wearing a helmet?
  • Wearing a helmet is an important part of motorcycle safety. If you weren’t wearing a helmet, you can still file a claim for damages against the at-fault driver; however, if the other side can prove that your lack of helmet contributed to your injuries (such as a traumatic brain injury), then your recovery award may be reduced in proportion to your degree of fault.

Large trucks are an integral part of our society, providing the goods and products that most of us rely on a daily basis. Without trucks, food, construction, household items, and more would never be delivered to Dade City businesses and residents.

But as necessary as large trucks are, they can also be dangerous. Weighing far more than an average personal car, a large truck can cause catastrophic damage if involved in a crash. If you have been in an accident with a large truck, our Dade City truck accident lawyers at the law office of the Kemp, Ruge & Green Law Group can help.

Truck Accidents in Dade City

Truck accidents are one of the deadliest types of motor vehicle accidents that can occur. When a truck and a smaller car collide, the smaller vehicle will likely sustain severe damages–it may be totaled or crushed completely. This means that any occupants of the smaller vehicle will likely be severely harmed. Common injuries in a Dade City truck accident include crush injuries, bone fractures, spinal cord injuries, internal injuries, traumatic brain injuries, lacerations, scarring and disfigurement, and more.

Damages recoverable in a Dade City truck accident claim

If you have been involved in a Dade City truck accident, you may be facing such severe physical and psychological injuries, as well as economic losses, that your life is changed forevermore. At the office of the Kemp, Ruge & Green Law Group, our Dade City truck accident attorneys want to make sure that you recover every cent that you have suffered in losses. We’ll advocate for your right to compensation for your:

  • Medical bills, which may total into the hundreds of thousands of dollars and may continue pouring in for months or years;
  • Lost wages and loss of earning capacity if you are unable to go to work or/and suffer a disability that prevents you from earning at the same level that you did prior to the accident;
  • Property damage costs for damage to your car and any personal items within your vehicle at the time of the collision; and
  • Noneconomic damages for the value of your diminished quality of life, psychological harm, physical pain and suffering, and mental anguish.

How truck accidents happen

One of the reasons that truck accident claims are so complicated is not just that the damages are so severe, but also because determining how the accident occurred may prove difficult. Truck accidents are usually the result of someone’s negligence, although whose negligence may not be clear. Some common causes of truck accidents include cargo shifts, vehicle defects (such as a tire blowout or brake failure), truck driver error, the error of a third-party, and more. Driving too fast for conditions, driving erratically or aggressively, and failing to look before changing lanes all increase the risk of an accident. Truck driver fatigue and impairment are also leading causes of crashes.

Common Questions About Truck Accidents in Dade City

  • How is fault determined?
  • When you hire our law firm, we will open a thorough investigation into your truck accident. We will consider truck black box data, physical evidence at the crash site, witnesses’ statements, the police report, and the opinions of accident reconstruction experts and other professionals.
  • How much time do I have to file a claim?
  • You should file your claim as soon as possible. You have four years from the date of the accident to file a lawsuit for damages, but filing a claim sooner rather than later is strongly recommended.
  • What should I do after a truck accident?
  • There are certain things that you should do right after a truck crash to preserve your right to compensation. Importantly, you need to seek medical care, file a police report, and report the accident to your insurer. You should also begin the process of gathering evidence immediately; however, if you are injured to the point where you cannot do this, you should consult with an attorney who can manage the investigatory process.

Driving in a car is a necessity, but it’s not always something that’s safe. In fact, car accidents are a leading cause of injury and death in Dade City and throughout the nation. If you are involved in a car accident, our Dade City car accident lawyers can provide you with the support and representation you need. Please call us today to learn more about how we can help.

Car Accident Claims in Dade City

A car accident can happen in the blink of an eye, and if it does, you may be left with long-term damages and severe injuries. Our lawyers have years of experience working on car accident claims and can represent you and advocate for your right to compensation. Types of car accident claims we take on include:

  • Rollover accidents;
  • Head-on collisions;
  • T-bone crashes;
  • Rear-end accidents;
  • Intersection crashes;
  • Single-vehicle collisions;
  • Pile-up crashes;

Damages from a car accident

When motor vehicles collide–especially when they are traveling at high speeds–the risk of severe injury is high. Types of injuries that are common in a car accident include back and neck injuries, head and traumatic brain injuries, internal injuries, spinal cord injuries, bone fractures, seat belt injuries, facial injuries, and soft tissue injuries.

When a car accident is serious and injuries are severe, the victim may incur high medical bills that they cannot possibly pay–in some cases, the person is uninsured, making these bills incredibly burdensome. If the injury is severe enough to prevent the affected person from working, then they will also suffer lost wages and a loss of earning capacity. Pain, suffering, and emotional distress are common noneconomic injuries that are suffered.

Who pays for damages from a car accident?

After a serious car accident, one of the most critical elements of a claim is determining who caused the accident and who should be held liable for damages. In Florida, a no-fault system is in place, which means that drivers must first file a claim with their own insurance company’s personal injury protection (PIP) coverage before they pursue damages against the other driver regardless of fault. In fact, a driver can only step outside of the no-fault system if they meet the injury threshold to do so. If you have been in a serious car accident, you can step outside of the no-fault system to pursue a claim against the other driver’s insurance company or file a lawsuit against the other driver. You will need to prove that your injuries would not have occurred but for the driver’s failure to uphold the duty of care owed to you in order for your claim to be successful.

Common Questions About Car Accidents in Dade City

  • How can I prove fault?
  • Proving fault in an accident is very important. If fault isn’t obvious, our law firm recommends a thorough investigation into your case. If you work with our lawyers, we can manage that investigation on your behalf and hire experts, such as reconstruction experts, integral to your claim.
  • How long will my case take?
  • How long a car accident claim takes can vary dramatically on a case-by-case basis. Some claims will be settled in a handful of weeks or a few months; others may end in litigation after a year’s time. How long your case will take likely depends on the complexity of the accident, fault, and the degree of your damages and injuries.
  • Should I accept the first settlement offer?
  • It can be so tempting to accept the first settlement that you are offered–you surely want nothing more than to receive compensation for your injuries and be able to move forward with your life. However, realizing your desperation, an insurance adjuster may offer you far less than you really deserve. You should never accept a first settlement offer that hasn’t been vetted by an attorney.
